In this section, we introduce you to the basic concepts related to the processing of personal data that we carry out at SkillHatch.

“Personal Information”means any information relating to a particular or identifiable individual.
“Manager”means the natural or legal person who alone or jointly with others determines the purposes and means of the processing.
“Processor”means a natural or legal person who processes personal data on behalf of the controller.
“Processing”means any action or set of actions performed in relation to personal data, such as collection, recording, editing, storage, modification, use or deletion.

What data do we collect and process?

We collect and process your personal data only on the basis of pre-defined purposes. Accordingly, we collect only the information we need to achieve these purposes.

The provision of personal data is always voluntary, except where the processing of personal data is required by law. We need certain personal data in order to conclude a contract — you also provide this data to us voluntarily, but if you do not provide the data to us, we cannot enable you to conclude a contract.

The collection and processing of personal data requires an appropriate legal basis in accordance with the General Data Protection Regulation, which is set out in more detail below.

Who do we provide your personal data to?

We share your personal data with third parties in the following cases:

Provision of personal data of candidates who apply for employers' tenders.As part of our services, we carry out transfers of candidates' personal data to potential employers for the purpose of the recruitment process.
Provision of data for the purposes of the functioning of the SkillHatch platform.For our platform to work we need external collaborators, so we can provide your personal data to: accounting, legal services, IT department, hosting provider, mass email provider.
Provision of data in the context of the provision of services.The SkillHatch platform uses artificial intelligence technologies to operate the services, with the help of OpenAI provider (PenAI Ireland Limited, with its registered office at 1st Floor, The Liffey Trust Centre, 117-126 Sheriff Street Upper, Dublin 1, D01 YC43, Ireland). In this case, personal data is also transferred outside the European Economic Area (EEA). The controller ensures that transfers of personal data are carried out on the basis of the relevant standard contractual clauses approved by the European Commission.

We transfer personal data to third parties only when this is necessary to fulfill the purpose of processing personal data. Third parties may access and process your personal data only to the extent and in the manner specified by the contract we enter into with them. In no case may third parties process personal data that are not necessary for the purpose for which they process personal data. All third parties are obliged to respect the level of protection of personal data provided by the controller.

Further disclosure of personal data in automated form

SkillHatch performs automated processing of personal data and profiling. Using the functionality of the platform (solving quizzes and other activities provided by the operator), individuals build their profile in the field of employability. Based on this profile, the individual is given the opportunity to contact potential employers who are looking for personnel with the skills and abilities demonstrated by the individual.

Such automated processing and, as a consequence, the creation of a profile of the individual, is necessary for the performance of the contract between the individual and the controller, since the composition of the profile, which the individual can use as a CV in the labour market, is an essential component of the contract. Thus, the individual does not have the possibility to request that decisions based on automated processing are not applied to him, since these are necessary for the performance of the contract.

The individual always has the possibility to terminate the contractual relationship and thus cease the processing.

How do we protect your personal data?

At SkillHatch, we make great efforts to ensure the security of your personal information, so we use a variety of technical and organizational measures to protect your personal information from destruction, deletion, unauthorized access and any other unauthorized alteration.

Personal data may only be processed by authorised persons with us or our contract processors.

The rules on the protection of personal data are amended and supplemented in accordance with changes in the legislation in the field of personal data protection.

In order to protect your personal data, we have taken various organizational and technical measures to protect your personal data:
backup of electronically stored personal data,
supervision of employees and regular checks on the performance of individual employees,
regular maintenance and updating of computer equipment,
limited access to personal data,
adoption of relevant internal policies and protocols with instructions on the protection of personal data.

We are aware that despite the security mechanisms we have put in place, a security incident may occur. To this end, we have developed a special protocol to deal with such incidents quickly, efficiently and in accordance with the law.

In the event of a security incident in which there is a likelihood that the rights and freedoms of individuals have been compromised, we will notify the competent supervisory authority immediately, but not later than within 72 hours. However, in the event of a security incident that may pose a significant risk to the rights and freedoms of individuals, we will immediately notify the individuals concerned.

What rights do you have on file?

With regard to the processing of personal data, you have the following rights in accordance with applicable law:

Right of access and printing:provides you with the opportunity to obtain confirmation as to whether personal data is being processed in relation to you and, where this is the case, to obtain access to that data and to obtain information about the purpose of the processing, the storage time, to whom the data is transmitted, whether automated decision-making or profiling is carried out, etc.
Right to rectification:provides you with the opportunity to request the controller to correct inaccurate personal data relating to you without undue delay.
Right to restriction of processing:you have the right to request that we temporarily restrict the processing of your personal data, e.g. for the duration of the rectification of the personal data we process about you.
Right to withdraw consent:provides you with the opportunity to withdraw your consent at any time, without any negative consequences for you. You can notify the cancellation by email to the address: info@skillups.io.
Right to erasure:provides you with the opportunity to request the controller to delete personal data relating to you without undue delay
Right to portability:in technically feasible cases, you may request that your personal data processed by us be transferred to another controller.
Right to contract:provides you with the opportunity to object to the processing of personal data at any time. You can exercise your objection by writing to us at: info@skillups.io.
Right to lodge a complaint with a supervisory authority:guarantees you the right to lodge a complaint with the Information Commissioner (Dunajska cesta 22, 1000 Ljubljana, e-mail: gp-ip@ip-rs.si, website: www.ip-rs.si) if you believe that the controller has violated the protection of personal data.

You can exercise all rights with the controller by sending a request to the e-mail address. You can do this yourself or through a proxy. Since we are committed to the highest level of security of personal data, we will respond to your request without undue delay within 30 days of receipt of the request. If this is not possible due to unforeseeable situations, you will be informed in advance and given another indicative deadline for preparing a reply.

We reserve the right to reliably identify you in the event of a request to exercise any of your rights. If you do not provide us with personal data on the basis of which we can reliably identify you, we will ask you for additional personal data. In the event that you do not provide us with additional personal data within the deadline, we will reject your request.
